NEC4 implementation

Energy & water infrastructure

Supporting NEC4 implementation across energy and water infrastructure

Training, contract preparation and project controls support across three separate assignments.

Concordia’s implementation work has included two energy infrastructure assignments and a water infrastructure assignment. Each involved preparing people, contracts or systems for the practical use of NEC4.

On one energy assignment, initial seminars helped the client examine how the contract would operate within its delivery arrangements. Discussions identified client-specific amendments, which were summarised and incorporated into the final contract. Training then extended to the delivery partners, with joint client–contractor workshops and bespoke sessions for team members with particular responsibilities.

On the second energy assignment, Concordia developed a training and implementation plan aligned with a RASCI analysis of roles and responsibilities. General training provided a common grounding in NEC4, while role-specific sessions and workshops addressed the work particular team members would undertake. The programme reflected the different levels of knowledge and involvement needed across the team.

For the water infrastructure assignment, Concordia worked with its delivery partners to design and implement a company-wide training programme. The work also included designing and implementing changes to the organisation’s project controls systems to align them with NEC4. This addressed both staff understanding and the systems through which the contract would be administered.

Further workshops and reviews are planned for the first energy assignment as implementation continues. They will provide opportunities to revisit the training in light of the team’s experience of using the contract.

Commercial management

Cost review & valuation

Establishing the project’s commercial position

Cost review and remeasurement on two separate assignments, establishing the overspend on a major project and the correct value of work on an airport project.

Two separate assignments involved examining project information to establish the cost position and the value of the work.

On a major project, Concordia reviewed the cost information and prepared a report identifying the overspend. The findings led to substantial changes to the project’s organisational structure and consultancy agreements, addressing the arrangements that had contributed to the problems and reducing the risk of the same mistakes being repeated.

The importance of the review extended beyond reporting the overspend. It gave the client a basis for changing how responsibilities were allocated and how consultancy services were engaged.

On an airport project, Concordia undertook a remeasurement using digital twin modelling to establish the correct value of the work. The exercise brought the measurement back to the project itself, using the digital model to support the assessment of quantities and valuation.

These assignments illustrate different aspects of commercial management: understanding what a project is costing, establishing what the work is worth, and using that information to make informed decisions.

Claims & dispute resolution

Building & infrastructure

Preparing and responding to construction claims

Advising predominantly head contractors on disputes arising from airport, office development and port infrastructure projects.

Concordia’s dispute appointments have included an airport redevelopment, a multistorey office development and a port infrastructure upgrade. These engagements have predominantly involved advising head contractors.

The work typically extends across several connected issues, including variations, payment, delay, disruption and the final account. Our involvement includes examining contractual entitlement, reviewing project records, assessing the amounts claimed and preparing or responding to claims.

A claim often requires the contract, correspondence, programme and cost information to be considered together. We work through those records to establish what happened, identify the evidence supporting the position and distinguish it from matters that remain uncertain or require further investigation.

Our support extends to negotiations and formal dispute proceedings. Delivery partners are involved where an assignment requires additional specialist expertise, with the work coordinated around the issues in dispute.

The scope of each appointment depends on the project’s circumstances and the stage the dispute has reached. It may involve addressing a particular claim or providing continuing assistance across the wider dispute.

Facilitation & adjudication

Independent dispute resolution appointments

Steven Evans and Raine Selles have been appointed as independent dispute resolvers in construction disputes. Their experience includes facilitation of a road infrastructure dispute and numerous appointments as adjudicators.

In these roles, they act independently, rather than as advisers to either party.

Commercial management education with RICS

RICS appointed Concordia to design and deliver its 13-module Commercial Management Fundamentals course.

The programme draws on Steven Evans’s experience of commercial management in practice, covering the decisions and responsibilities involved throughout a construction project.

Steven has also chaired the RICS Commercial Management in Construction annual conference for Australia and New Zealand for the past five years.
