In practice, many subcontractors encounter commercial difficulties not because they lack technical capability, but because they have not been given the contractual, commercial and legal knowledge needed to properly protect their position.

Main contractors frequently rely upon this lack of commercial knowledge, particularly in relation to payment rights, notices, time obligations and the protections available under the Construction Contracts Act 2002.
