About this course

Delay and disruption remain the most common causes of disputes on construction projects. In practice, however, disputes concerning extensions of time, liquidated damages and disruption claims are rarely caused by delay alone. They are often driven by poor administration, inadequate records, weak programme management and misunderstanding of contractual and legal principles relating to time.

Issues involving notices, time bars, concurrent delay, substantiation and causation regularly arise under commercial pressure during project delivery. Claims are frequently rejected on procedural grounds without proper consideration of whether the contract contains an effective time bar or whether the assessment process has been carried out correctly. Equally, many project teams struggle to properly demonstrate cause and effect or adequately substantiate delay and disruption claims.
